11. Indemnification

You agree to defend, indemnify, and hold harmless Tooth Acres Dentistry from any claims, damages, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or violation of these Terms.

12. Dispute resolution

Before filing any claim, you agree to first contact us at office@toothacresmountdora.com so we can try to resolve the matter informally. If we cannot resolve the dispute within thirty (30) days, any remaining dispute, claim, or controversy arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Mount Dora, FL, or another mutually agreed location. You and we waive any right to a jury trial and to participate in a class or representative action. Either party may bring an individual action in small-claims court instead.

13. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. Subject to Section 12, the state and federal courts located in Lake County, Florida will have exclusive jurisdiction over any matter not subject to arbitration.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Effective" date above. Your continued use of the Site after changes become effective constitutes acceptance of the updated Terms.
